Douglas J. Olcott: Legal malpractice is a claim that can be made where the attorney who has handled a claim has made a mistake. Legal malpractice is where the attorney, through their negligent actions, has done something to hurt your case or cause you to lose a case.

The easiest example is you’ve been involved in an accident; under Pennsylvania law you generally have two years within which to file a claim. For whatever reason the attorney misses that two year date so that they don’t file a claim within the time frame allowed by law. That would have been the attorney’s negligent act that now caused you to lose your case against the original party who may have caused you injury.

Because you lost your opportunity to pursue a claim against the original party the only alternative you have now is to file a legal malpractice claim against your attorney who, for lack of a better term, bungled your case.
