[GRAPHIC: Ask Super Lawyers, Can I sue a drunk driver in Pennsylvania? Attorney Douglas J. Olcott responds.]

Douglas J. Olcott: If you've been involved in a car accident in Pennsylvania with a drunk driver, you absolutely have the right to sue the person who is responsible. The other thing we look at if you've been involved in an accident involving a drunk driver is where did that person get their alcohol from, because there are different rules. If they were drinking at a private residence, there may or may not be any liability there. If they were at an establishment, whether that's a restaurant, a bar, then that party may also bear responsibility for serving a person to the point where they become visibly intoxicated. And often times the victims of a drunk driving accident sustain significant injuries, and the insurance available for the automobile policy isn't enough. And in those circumstances, we always like to look to see if there's a secondary party that would be responsible so that the innocent victim can be fully compensated for the injuries they incurred.
